Podestá's Saladeristas: A Historical-Judicial Reading of an Emblematic Case for Environmental Law

This article reconstructs the legal conflict of the case known as the “Podestá Salad Makers” case, recognized by environmental law as the first leading case in this branch of law. The review assesses the degree of importance of judicial intervention in the conflict and establishes a chronology spanning from the parliamentary initiatives of 1871 to the landmark ruling of the Supreme Court of Justice of the Nation in 1887. Priority is given to the analysis of the provincial courts (1875-1878) to observe the jurisdictional trajectory of the case. The study of this case provides a valuable framework for examining several issues: first, the existing legislation regarding the issues at the heart of the conflict (public health, property rights, public hygiene), as well as observing the jurisdictional trajectory of the case. Second, it contextualizes the case within the legal traditions invoked in the judicial arguments. Ultimately, the study considers the public repercussions of the conflict, which unfolded during a critical period of cholera and yellow fever epidemics. The sources used, through lawsuits, court rulings, records, and official documentation, recover diverse perspectives on the conflict.
